Terms of Service

These Terms of Service ("Terms") are an agreement between you and Michael Spigener d/b/a Skye Front Desk ("Skye," "we," "us"), which operates the Skye front desk service at skyefrontdesk.com and app.skyefrontdesk.com (the "Service"). By creating an account or using the Service, you agree to these Terms. If you use Skye for a business, you confirm you're authorized to accept these Terms for that business.

1. What Skye does

Skye is an AI-powered front desk for independent service businesses such as coaches, trainers, and therapists. Depending on your setup, Skye can answer calls and text messages from your clients on your behalf, book and manage appointments, send reminders, help collect payments, and give you a dashboard and a text-based assistant ("concierge") to manage your schedule.

2. Your account

  • You must be at least 18 and provide accurate information.
  • You're responsible for your login, for activity on your account, and for keeping your business details, hours, prices, and policies up to date in Skye.
  • Tell us right away at support@skyefrontdesk.com if you think your account has been accessed without permission.

3. Free trial, billing, and cancellation

  • Free trial. New accounts get a 30-day free trial. No card is required to start. Texting requires a card on file, because carrier registration begins once you add one. If carrier registration for texting is pending, we may extend your trial.
  • Price. After the trial, Skye costs $89 per month (plus any applicable taxes), billed in advance through our payment processor, Stripe.
  • Automatic renewal. Your subscription renews monthly until you cancel.
  • Cancel anytime. You can cancel from your dashboard's billing settings. Cancellation takes effect at the end of your current billing period. We don't give partial-month refunds except as stated below.
  • Money-back guarantee. If you're not satisfied within the first 60 days of paid service, contact us and we'll refund the subscription fees you paid during that period.
  • When a trial ends without a card. Skye keeps working for a short grace period, then pauses. While paused, calls get a take-a-message greeting and texts get a brief "we'll get back to you" reply, no new bookings are made, and you aren't charged. Your data stays in your account, and adding a card turns Skye back on.
  • Failed payments. If a payment fails, we'll notify you and retry. If it isn't resolved within the grace period shown in your dashboard, Skye pauses until it is.
  • Price changes. We'll give you at least 30 days' notice before any price change takes effect on your subscription.

4. Texting and calling — your responsibilities

Business texting in the US is regulated. You agree that:

  • Consent. You'll only have Skye text people who have given you permission to contact them by text (for example, clients and parents who share their number with you to schedule services). You won't use Skye to send unsolicited marketing texts.
  • Carrier registration. To text, your business must be registered with US carriers (A2P 10DLC). You'll give us accurate business information for that registration. Carrier approval is outside our control and usually takes 1–2 weeks.
  • Opt-outs. Anyone can reply STOP to stop texts. Skye honors opt-outs automatically, and you won't try to message someone who opted out.
  • Calls. Skye's greeting tells callers they're speaking with a virtual assistant and that the call may be recorded or transcribed. Skye converts what callers say to text in real time so it can respond; it does not store call recordings. If your state or business requires any additional notice or consent, you're responsible for providing it.
  • Laws. You'll follow laws that apply to your communications, including the Telephone Consumer Protection Act (TCPA) and carrier rules.

5. AI limitations

Skye uses artificial intelligence to understand and reply to messages and calls. AI can make mistakes. For example, it can misunderstand a request, book the wrong time, or give an incomplete answer.

  • Skye is designed to confirm changes before making them and to flag uncertain conversations for you. You're still responsible for reviewing your schedule and client communications.
  • Don't rely on Skye for emergencies, safety-critical situations, or medical, legal, or financial advice. Skye is not an emergency service.
  • You're responsible for the business information and policies you give Skye to share with clients.

6. Payments from your clients

If you collect payments from your clients through Skye, those payments are processed by third-party providers (such as Stripe or Square) under their own terms. Skye isn't a party to transactions between you and your clients and isn't responsible for disputes, refunds, or chargebacks between you and them. Fees charged by those providers are your responsibility.

7. Your data and your clients' data

  • You own your data. You own the business and client information you put into Skye.
  • How we handle it. We process your clients' information on your behalf to provide the Service, as described in our Privacy Policy.
  • Your permissions. You confirm you have the right to share your clients' information with Skye, including information about minors (such as student names and ages), with the permission of a parent or guardian where required.
  • Deleting your account. You can delete your account from your dashboard. Deletion starts with a 7-day window: Skye pauses right away, your subscription is canceled, and you can undo the deletion from your dashboard during those 7 days. After that, we permanently delete your account data, release your Skye phone number, and remove your voice assistant. You can ask us for a copy of your data before then.
  • After cancellation. If your subscription is canceled and not restarted, we keep your data for 90 days so you can reactivate. We'll email you 7 days before it's permanently deleted.
  • Billing records. We keep billing records (such as invoices and subscription history) as needed for tax, accounting, and legal purposes.

8. Acceptable use

You won't use Skye to:

  • Break any law or send spam, harassing, deceptive, or unlawful messages.
  • Impersonate anyone, or misrepresent your business.
  • Send content involving illegal products or services, or content carriers prohibit.
  • Interfere with or try to break the Service, access other customers' data, or reverse engineer it.
  • Resell or share the Service outside your own business without our written permission.

9. Phone numbers and integrations

  • We provide a new, dedicated phone number for your Skye line through our telecom provider. The number is part of the Service while your account is active; it can't be transferred (ported) to another provider, and it's released when your account is deleted.
  • If you connect third-party services (such as Google Calendar, Square, or Stripe), you authorize Skye to access them as needed to provide the Service. Their own terms apply.

10. Suspension and termination

We may suspend or terminate your account if you materially break these Terms, misuse texting or calling, fail to pay, or if required by law or a carrier. Where reasonable, we'll notify you first and give you a chance to fix the issue. You can stop using Skye and cancel at any time.

11. Disclaimers

The Service is provided "as is" and "as available." To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the Service will be uninterrupted or error-free, or that every call or message will be answered or delivered. Carrier and network delivery are outside our control.

12. Limitation of liability

To the extent the law allows, Skye won't be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, clients, or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim.

13. Indemnity

You'll defend and indemnify Skye against third-party claims arising from your use of the Service in violation of these Terms or the law, including claims about messages sent without proper consent.

14. Changes to these Terms

We may update these Terms. If we make material changes, we'll notify you by email or in your dashboard at least 30 days before they take effect. Continuing to use Skye after that means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Galveston County, Texas.
